Preamble
This charter (the “Privacy Policy”) describes the policy for processing personal data collected by Jinghi, a limited liability company (société à responsabilité limitée) with a share capital of EUR 15,996, registered with the Paris Trade and Companies Register under number 381 279 165, whose registered office is located at 11 Place des Vosges, 75004 Paris, and operating under the trade name and brand LEMAIRE (“LEMAIRE” or “we”). It also sets out our rules regarding the management of cookies when browsing the website https://www.lemaire.fr, of which we are the owner.
This Privacy Policy is intended to inform you, regardless of your status (customer, candidate, subcontractor, partner, supplier, or website user) (“you”), of how we process your personal data in the context of our relationships.
LEMAIRE respects your concerns regarding the confidentiality of the personal information we collect. Accordingly, LEMAIRE undertakes to protect and ensure the security and confidentiality of your personal data, in particular by taking all appropriate precautions to prevent such data from being altered, damaged, or accessed by unauthorized third parties.
LEMAIRE implements technical security and management measures in line with current best practices, particularly with regard to information systems. However, LEMAIRE does not control all risks associated with the operation of the Internet and draws your attention to the existence of risks inherent in its use and operation.
This Privacy Policy complies with the applicable legal provisions on the protection of personal data, in particular those defined by Regulation (EU) 2016/679 (the “GDPR”) and by French Law No. 78-17 of January 6, 1978, known as the “Data Protection Act”.
1. What is personal data?
Personal data is any information that makes it possible to identify you personally as a natural person, directly or indirectly, in particular by reference to an identifier such as a last name, first name, address, identification number, or to one or more elements specific to your identity (physical, cultural, social, etc.).

In all circumstances, we undertake to ensure that your personal data is collected and processed solely for the purposes mentioned above, in accordance with the principles of proportionality and data minimization.
Furthermore, we retain your personal data for a period that does not exceed what is necessary to achieve the purposes of the relevant processing. In other words, the data retention periods we apply may vary depending on the purpose for which the personal data is processed.
In any event, at the end of the applicable retention period, we will irrevocably delete or anonymize your personal data so that you can no longer be identified.
Information that is not required to process your orders or requests is identified as “OPTIONAL” on the data collection forms available on our website. If you do not complete the mandatory fields, we will not be able to process your orders or requests.
4. How is your data collected?
LEMAIRE collects and processes your personal data directly from you. If LEMAIRE were to collect your personal data indirectly, you would be informed at the time of collection.
5. Who are the recipients of your data?
Within the limits of their respective responsibilities and for the purposes recalled in Article 3 of this Privacy Policy, the categories of recipients who may have access to your data include:

In order to combat fraudulent payments during online purchases, the payment service provider implements a risk assessment and fraud prevention procedure using algorithms.
6. Is your data transferred outside the European Union?
Wherever possible, LEMAIRE prioritizes the use of subcontractors located within the European Union.
However, LEMAIRE may transfer your data outside the territory of the European Union, for example in connection with order processing and payment management.
Such transfers are carried out in accordance with the provisions of the GDPR, and LEMAIRE implements all required safeguards to secure your personal data, in particular by selecting subcontractors located in countries offering an adequate level of protection or by applying the European Commission’s standard contractual clauses, supplemented where necessary by additional safeguards.

9. How can you exercise your rights?
To exercise your rights, you must contact LEMAIRE’s dedicated service using the contact details provided in Article 10 of this Privacy Policy, in particular by email at customerservice@lemaire.fr.
You must clearly identify yourself so that we can ensure we do not modify or delete personal data relating to the wrong person.
In order to properly process your request, we may ask you to provide additional information to confirm your identity and/or facilitate the identification of the personal data concerned (e.g. a copy of an identity document or any other document allowing us to verify your identity).
A response to a request based on one or more of your rights will be sent within one month from receipt of the request.
Please note that some of your rights are subject to specific conditions set out in applicable data protection regulations, in particular the GDPR. If your specific situation does not meet these conditions, we may not be able to comply with your request. In such cases, we will inform you of the reasons for the refusal.
